Rome II Commission report roundtable: collective actions

Conflictoflaws.net held a virtual roundtable on the Commission report on the Rome II Regulation on 11 March 2025. The long-awaited Commission report on the functioning of the Rome II Regulation on the applicable law to non-contractual obligations was published in January, following an extensive evaluation study that was released in October 2021. Xandra Kramer contributed to that study as a reporter for the Netherlands. At the roundtable the findings of the Commission were discussed, focusing on privacy rights and SLAPPs, financial disputes and prospectus liability, artificial intelligence, and collective actions. Xandra discussed the difficulties arising determining the applicable law in collective actions in case the damage occurs in different countries and concluded that along with the jurisdiction rules under Brussels I-bis reassessing the rules on the applicable law is necessary.
